Testing, analysis, and evaluation of the knowledge, skills and abilities of others in the field of allied healthcare to determine conformity with certification standards Applicant respectfully disagrees with the refusal under Section 2(e)(1). The mark "NATIONAL PERFORMANCE SPECIALISTS" is not merely descriptive but is, at most, suggestive of Applicant's services. A mark is considered merely descriptive only if it immediately conveys knowledge of a quality, feature, function, or characteristic of the services. In contrast, a suggestive mark requires imagination, thought, or perception to determine the nature of the services. Here, the composite phrase "NATIONAL PERFORMANCE SPECIALISTS" does not directly describe a specific service. Instead, it creates a commercial impression of a professional organization with elevated expertise and authority in performance-related domains. The wording does not identify: - a specific certification, - a defined testing methodology, - or a particular healthcare discipline. Rather, the mark functions as a brand identifier suggesting a level of prestige, scope, and specialization, requiring a mental step to associate it with Applicant's certification and evaluation services. Additionally, the combination of the terms creates a unitary commercial impression distinct from the mere sum of its parts. Accordingly, the mark is suggestive and eligible for registration on the Principal Register.
